About Sky Path Credit

Sky Path Credit is a licensed direct lender operating under federal and tribal laws. We specialize in providing installment loans to qualified borrowers who need short-term financial assistance. As a tribal lending entity, we are wholly owned and operated by [Tribal Entity Name], a sovereign nation recognized by the United States federal government.

Our services include online loan applications, loan processing, customer account management, and related financial services. We operate in compliance with applicable federal lending laws and tribal regulations.


Eligibility and Account Requirements

Basic Eligibility

To be eligible for our services, you must be at least 18 years old, be a U.S. citizen or permanent resident, have a regular source of income of at least $1,200 per month after taxes, maintain an active checking account in good standing, and provide accurate and complete information in your application.

Military Lending Act Compliance

In accordance with the Military Lending Act, active duty servicemembers, their spouses, and dependents are not eligible for our loan products. We will verify military status as part of our application process.

Account Security

You are responsible for maintaining the confidentiality of any login credentials associated with your account. You must notify us immediately if you become aware of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account information.


Loan Application Process

Application Accuracy

All information provided in your loan application must be truthful, accurate, and complete. You authorize us to verify any information you provide through third-party sources including credit reporting agencies, employment verification services, and banking institutions.

Application Review

We reserve the right to approve or deny any loan application in our sole discretion. Approval is not guaranteed, and we may consider various factors including your credit history, income, employment status, and ability to repay. We will notify you of our decision as promptly as possible.

Electronic Communications

By applying for a loan, you consent to receive communications from us electronically, including loan documents, account statements, payment reminders, and other important notices. You agree that electronic communications satisfy any legal requirement for written communications.


Loan Terms and Repayment

Loan Agreement

If approved, your specific loan terms including the principal amount, interest rate, payment schedule, and total cost will be detailed in your individual loan agreement. You must review and electronically sign your loan agreement before funds are disbursed.

Payment Obligations

You agree to make all payments according to the schedule outlined in your loan agreement. Payments will be automatically withdrawn from your designated bank account on the scheduled due dates via ACH unless you arrange for alternative payment methods.

Late Payments and Fees

If you fail to make a scheduled payment, you may be subject to late fees as specified in your loan agreement. We may also charge returned payment fees if a payment is returned by your bank for insufficient funds or other reasons.

Default and Collection

If you default on your loan, we may declare the entire unpaid balance immediately due and payable. We may pursue collection activities including reporting to credit bureaus, engaging third-party collection agencies, and taking legal action to recover amounts owed.

Individual Loan Agreements

Changes to these general Terms of Service do not modify the specific terms of existing loan agreements. Your individual loan agreement will remain in effect according to its original terms unless modified through a separate agreement.

Termination

Termination by You

You may stop using our services at any time, but you remain responsible for all outstanding loan obligations and must continue making payments according to your loan agreement.

Termination by Us

We may terminate or suspend your access to our services immediately if you violate these Terms of Service, provide false information, or engage in fraudulent activity. Termination does not relieve you of your obligations under any existing loan agreement.

Effect of Termination

Upon termination, your right to use our services ceases immediately. All provisions of these Terms of Service that should survive termination will remain in effect, including payment obligations, liability limitations, and dispute resolution procedures.


General Provisions

Entire Agreement

These Terms of Service, together with your individual loan agreement and our Privacy Policy, constitute the entire agreement between you and Sky Path Credit regarding our services.

Severability

If any provision of these Terms of Service is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any provision of these Terms of Service does not constitute a waiver of our right to enforce that provision in the future.

Assignment

You may not assign or transfer your rights under these Terms of Service without our written consent. We may assign our rights and obligations under these terms to any affiliate or successor entity.

Electronic Signatures

You agree that electronic signatures, contracts, and records have the same legal validity as traditional paper documents. You consent to conducting business electronically and receiving all documents and communications in electronic format.

Sky Path Credit is a tribal lender operated by a sole proprietor who is a member of a federally recognized First Nations tribal group in Canada. The lender is an active member of the First Nations Lenders Alliance (FNLA) — a membership based organization of First Nation tribal lenders that serves as an external regulatory resource and promotes best practices in the consumer lending industry.

Your loan will be made by a sovereign tribal lending entity and is subject to the lending laws and policies established by that tribal entity, not the laws of your state of residence. The laws of your state may contain interest rate limits and other consumer protection provisions that could be more favorable to you. If you prefer to have your state’s laws apply, you should consider borrowing from a licensed lender located within your state.

SkyPath Credit does not lend to residents of Arizona, Arkansas, Colorado, Connecticut, DC, Georgia, Maine, Illinois, Maryland, Massachusetts, Minnesota, Montana, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Oregon, South Dakota, Vermont, Washington, West Virginia, Wisconsin, Virginia, Pennsylvania. Availability of installment loans are subject to change at any time at the sole discretion of Sky Path Credit.
